Kiesel Law LLP has been appointed as trial counsel for a certified class of Dodge Dart owners in Federal Court. The Court has approved Kiesel Law LLP being brought in to try the class action claims against Fiat Chrysler for allegedly defective manual transmission Dodge Darts.
The trial is currently scheduled to begin on October 11, 2022, in the United States District Court, Southern District of California.
More Information About Dodge Dart Problems
The Fiat Chrysler class action lawsuit was filed by plaintiff Carlos Victorino in 2016. It alleges the presence of a product defect in the clutch master cylinders of Fiat C635 transmissions used in 2013-2015 Dodge Darts. This defect results in hydraulic fluid leaks which can damage transmissions.
It also causes clutch pedals to stick to the vehicle’s floor, preventing proper shifting. Victorino further asserts that Fiat Chrysler’s failure to recall the vehicles endangered drivers by inhibiting their ability to shift gears and control the vehicles’ speed.
UPDATE: Fiat Chrysler Class Action Lawsuit Settled Out of Court
A settlement for the Fiat Chrysler class action lawsuit pertaining to the above-described 2013-015 Dodge Dart problems was finalized on September 29, 2023.
Fiat Chrysler has agreed to reimburse Dodge Dart owners who originally paid out-of-pocket for vehicle repairs (owners who have already been reimbursed do not qualify) and to award Victornio $20,000 as a service payment.
Additionally, Fiat Chrysler has agreed to provide a 12-month warranty extension, beginning the day after final approval of the settlement. This extension expands coverage for repair or replacement of the clutch cylinder under the powertrain limited warranty.
