CHP Settles Fullerton Shooting Case for 4.5 Million

Kiesel Law LLP recently settled a difficult police shooting lawsuit for $4,500,000. The case involved an unlawful shooting in Fullerton, CA, by two California Highway Patrol (CHP) Deputies, resulting in the wrongful death of our client.

Kiesel Law LLP was able to successfully defeat both the Defendants’ Motion for Summary Judgment on the issue of Qualified Immunity, as well as the Defendants’ Appeal to the 9th Circuit Court of Appeal.

More About the Fullerton Shooting Case

The Fullerton shooting occurred on July 3, 2016. Two CHP deputies in an unmarked police vehicle attempted to apprehend our client after allegedly witnessing an illegal traffic maneuver. Upon pursuing our client’s vehicle down a dead-end street, our client turned around and attempted to drive around the unmarked police vehicle under the assumption the occupants were carjackers.

Deputies then opened fire, killing our client. An eyewitness testified that the plainclothes officers made no effort to identify themselves as police until after the shooting. Furthermore, eyewitness testimony asserts that deputies provided no CPR or further treatment until paramedics arrived.

Kiesel Law attorneys contended that the deputies’ actions constituted unreasonable force. Following the dismissal of the Defendants’ Motion for Summary Judgment on the issue of Qualified Immunity and the Defendants’ Appeal to the 9th Circuit Court of Appeal, the CHP agreed to settle the police shooting lawsuit for a sum of $4,500,000.
