Toshiba Class Action Model 6100-Settled

I am pleased to report Judge Emilie Elias granted full and final approval to the Sattelite Pro 6100 settlement class action. January 13, 2006 update:
On December 8, 2005, Judge Emilie Elias of the Los Angeles County Superior Court granted preliminary approval to a settlement of the class action and conditionally certified a class of all end-user persons or entities who purchased or otherwise acquired in the United States, for their own use and not for resale, a new Toshiba satellite Pro 6100 Series notebook computer. The exact terms are explained in the official notice which has been mailed and e-mailed to all known class members. In general terms, the settlement includes an extended warranty for all satellite Pro 6100 computers, cash compensation for certain repairs, and reimbursement for certain out-of-warranty repair expenses. A settlement hearing will be held on March 17, 2006 for the court to determine whether the settlement is fair, reasonable, and adequate and whether it should be approved by the Court. The official Court-approved notice will have much more detailed information related to the Settlement. The Claims Administrator overseeing the submission of claims for this matter is the Garden City Group (GCG). GCG has established a web site for all Satellite Pro 6100 class members as follows: sp6100settlement.com. You can obtain the official claim form, review the terms and conditions of the settlement, as well as recieve answers to frequently asked questions by visiting their web site.

We have been engaged in discussions with Toshiba concerning a potential resolution of the 6100 model series laptop computer. A Class Action was brought against Toshiba Information Systems, Inc. on behalf of the more than 120,000 owners of the Toshiba Satellite 6100 model laptop. The 6100 suffered from numerous defects among them problems with the video display and motherboard systems. The action is currently pending at the Central Civil West (complex litigation court) of the Los Angeles Superior Court. Toshiba and the plaintiff attorneys have been engaged in the investigation of the defects (known as the discovery process). A settlement conference between Toshiba's representatives and the plaintiff attorneys is presently scheduled for August 15, 16 and 17, 2005. Paul Kiesel is Co-Lead Counsel of this litigation.
